“Fees are set according to custom, depending on the client’s financial situation, the difficulty of the case, the costs incurred by the lawyer, his reputation and his diligence. The lawyer in charge of a case may request fees from his client even if the case is withdrawn before its conclusion, to the extent of the work carried out.”

‘The lawyer’s remuneration depends, in particular, on each of the following elements in accordance with custom :

  • the time devoted to the case

  • research work,

  • the nature and difficulty of the case,

  • the importance of the interests involved,

  • the impact of the fees and charges of the law firm to which he belongs,

  • his reputation, qualifications, seniority, experience and specialisation,

  • the advantages and results obtained for the client by his work, as well as the service rendered to the client,

  • the client’s financial situation’.

(National Internal Rules of the Legal Profession – RIN)

Three types of fees are possible. (flat-rate fees, time-based fees and result-based fees).

Fixed fee

Isabelle CARLES prefers a flat-rate fee, which gives her a clear idea of the cost of the proceedings and enables her to set up a payment schedule if necessary.

The fixed fee covers all the work entrusted to Me CARLES, but does not include ancillary costs (bailiffs, purchase of court stamps, etc.).

The amount is fixed by a fee agreement concluded in advance between Me Isabelle CARLES and the client.

Fees based on time spent

This fee is based on the time spent on the case, according to an hourly rate announced by the lawyer during the initial consultation.

This fee is suitable for cases with a high degree of uncertainty, where it is difficult to predict the exact number of hours required. When this option is chosen, Isabelle CARLES undertakes to indicate a provisional fee range.

Result fees

Agreed with the client in the fee agreement, this represents an additional fee if the result sought in the proceedings is achieved.

Legal protection

This is an insurance policy that allows you to benefit from legal advice or the assistance of a lawyer in legal proceedings. This insurance is sometimes offered as part of car or home insurance, but you can also take it out directly.

Your insurance company may cover some or all of the fees. Despite this financial coverage, the client remains free to choose his or her lawyer.

When you do not have sufficient resources or insurance, the State may cover the costs of proceedings.

Me Isabelle CARLES accepts legal aid for all contentious proceedings (appeals to the administrative court, the administrative court of appeal, referral to a judicial judge, etc.).
